The reconciliation bill passed the Senate with McConnell-backed provisions targeting hemp-derived cannabinoids, including Delta-8 and Delta-9 THC products sold outside the pharmaceutical channel.
The hemp-specific language is now in conference between the House and Senate versions. Outcome will determine whether hemp-derived products face a de facto ban or a regulated pathway.
Several hemp industry associations have filed for injunctive relief, arguing the provisions exceed congressional authority under the Farm Bill framework.
